Conditions
1. Scope
These general terms and conditions apply to the sale and delivery of goods by Weingut Taferner, as well as to the sale of products in the web shop. Deviating conditions of the customer require a written confirmation from Weingut Taferner. At the latest when placing the order, the customer agrees to these General Terms and Conditions.
2. Conclusion of contract
The contract, order and business language is German. Offers are subject to change and valid while stocks last, last offer overrules all existing offers. Weingut Taferner accepts orders by post, e-mail, telephone or via the online shop www.tafi.at. The customer's order represents an offer to Weingut Taferner to conclude a purchase contract. The customer will be informed of the acceptance by e-mail. If Weingut Taferner cannot fulfill the customer's order for any reason, the customer will be informed.
3. Prices and Delivery
The prices are gross prices in EURO per item and include all statutory taxes and duties for domestic deliveries. Special packaging such as wooden boxes (unless otherwise stated) and shipping costs are excluded.
Deliveries are made, depending on the scope, by parcel service or forwarding agent. The corresponding shipping costs are displayed or announced to the customer during the ordering process and added to the total invoice amount.
Deliveries outside of Austria may incur additional costs (customs duties, levies, etc.) that lead to a change in prices. In this case, Weingut Taferner will inform the customer of the additional costs.
In the event of non-acceptance of ordered goods, Weingut Taferner is entitled to demand the additional costs incurred as a result. This does not apply if Weingut Taferner does not provide its services in accordance with the contract.
4. Retention of title and terms of payment
The goods remain the property of Weingut Taferner until the purchase price including additional costs has been paid in full.
When ordering via the online shop, payment is made by credit card, Klara or PayPal. Unless otherwise agreed, all other contracts are due at the latest upon delivery of the goods.
5. Passing of risk and damage in transit
In the case of farm-gate purchases, the risk passes to the customer when the goods are handed over at the checkout.
Weingut Taferner grants compensation for damage during transport if the customer
• the goods are checked for completeness and correctness immediately upon arrival,
• Report any defects immediately to Weingut Taferner and
• have any complaint confirmed by the carrier.
6. Right of Withdrawal
Customers who are consumers within the meaning of the Consumer Protection Act can withdraw from a distance contract within a period of 14 days by means of a written declaration of withdrawal. The withdrawal period begins upon receipt of the delivery of the ordered goods. It is sufficient if the written declaration of withdrawal is sent within the period without giving reasons.
In the event of withdrawal, a full or partial refund of the purchase price will only take place step by step against the return of the goods received from the customer. The costs of the return are at the expense of the customer. If the goods are returned freight collect, Weingut Taferner is entitled to withhold a corresponding amount. The return of the goods in the original packaging must be made exclusively to Weingut Taferner, Pfarrgasse 2, 2464 Göttlesbrunn. For items that are affected by signs of use, we will charge an appropriate fee for the reduction in value.
The customer's right of withdrawal is excluded for contracts for goods that are manufactured according to customer specifications or are clearly tailored to personal needs, as is the case in particular when applying or producing print templates for individual labels.
7. Warranty
Warranty claims require that defects are reported to Weingut Taferner immediately.
• recognizable defects immediately upon acceptance (see also transport damage)
• hidden defects after discovery, and upon presentation of the opened goods and the original invoice
A warranty claim is in any case limited to the purchase price of the delivered and defective goods.
Reasons of taste, commercial or minor, technically caused deviations in quality, quantity, color, size, weight, equipment or design as well as age-related changes in taste, color and packaging do not constitute warranty defects or non-fulfillment of the contract.
Weingut Taferner is not liable for taste, color, material and sample correspondence or other characteristics of the reordered goods. The same applies to goods ordered based on a sample, provided the deviation is within the customary and technical limits.
Any warranty is excluded after the goods have been tasted, consumed or processed or processed.
8. Damages
The liability of Weingut Taferner is based exclusively on the agreements made in the above points. Further claims by the customer, regardless of the legal basis, including claims for damages, are excluded.
9. Protection of Minors
The sale and delivery of wine and spirits can only be made to persons over 18 years of age. By placing the order, the customer assures that he or the recipient of the goods is older than 18 years.

11. Place of Performance and Jurisdiction
The place of performance is the registered office of Weingut Taferner, even if the goods are handed over at a different location as agreed.
The contract is subject to Austrian law to the exclusion of the UN Sales Convention.
The factual and locally competent court at Weingut Taferner's headquarters is exclusively responsible for deciding all disputes arising in connection with the contract.
12. Miscellaneous Provisions
If individual provisions of these General Terms and Conditions are invalid, this does not result in the invalidity of the entire contract. Rather, the ineffective or unenforceable provision shall be replaced by an effective or enforceable provision that comes as close as possible to the economic result of the ineffective condition.
